The Short Answer: Medical Yes, Recreational No
Medical cannabis is legal in Pennsylvania for patients with one of 24 qualifying conditions under Act 16 of 2016 (35 P.S. §§ 10231.101–2110). The program serves over 440,000 registered patients — making Pennsylvania the largest medical-only cannabis market in the United States.
Recreational cannabis is illegal. Possession of any amount without a medical card is a criminal offense. Cultivation of any cannabis plant is a felony in Pennsylvania — even for medical patients. The state has no home grow provision of any kind.
Pennsylvania is now surrounded by legal recreational markets. Five of its six neighbors — New Jersey, New York, Maryland, Delaware, and Ohio — have legalized adult-use cannabis. Only West Virginia remains medical-only alongside Pennsylvania.

Pennsylvania Is an Island
Pennsylvania's refusal to legalize recreational cannabis is increasingly conspicuous. The state is now bordered by legal markets on nearly every side:

This means Pennsylvania residents drive to neighboring states to purchase recreational cannabis — taking their tax dollars with them. Governor Shapiro estimates the state is losing hundreds of millions of dollars annually to border-state competition.
Even if you legally purchase cannabis in New Jersey, New York, or another neighboring state, transporting it into Pennsylvania without a medical card is a criminal offense. Interstate transport of cannabis is also a federal crime.
The Rec Legalization Push
Pennsylvania came closer to recreational legalization in 2025 than ever before. HB 1200 passed the House by a razor-thin 102-101 margin on May 7, 2025 — the first time either chamber of the PA General Assembly had passed a recreational cannabis bill. However, the Senate Law & Justice Committee tabled the bill 7-3 just six days later.
Governor Josh Shapiro has publicly supported legalization, projecting $729 million in first-year revenue and calling it an "issue of freedom and liberty." With 68% of Pennsylvania voters supporting legalization, the obstacle is not public opinion but the Republican-controlled Senate (27 of 50 seats).
